Terms of Service

1. Acceptance of Terms

By accessing or using Symbol at symbol.chat, or any associated applications or APIs (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. The Parties

These Terms constitute a legal agreement between you ("User", "you", "your") and Databoy Pro Sites Limited, a company registered in Zambia, operating under the trade names Symbol and Symbol Chat ("we", "us", "our", "Company"). Our company website is prosites.co.zm.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service where required by applicable law. By creating an account, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and complete.

4. Description of Service

Symbol is a knowledge management platform that allows users to save, organize, and reuse structured context ("Capsules") for use with AI tools. The Service includes a web application, REST API, and MCP (Model Context Protocol) server for AI integration, as well as associated mobile and desktop applications.

5. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials, including passwords and API keys. You must provide accurate information and keep it up to date. You are responsible for all activity that occurs under your account, whether or not authorized by you. You must notify us immediately of any unauthorized use of your account.

6. Your Content

You retain full ownership of all content you create within the Service, including Capsules, Types, and file attachments. By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, display, and process your content solely for the purpose of providing the Service to you. We do not use your content to train AI models, and we do not claim any intellectual property rights over your content.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Upload content that infringes on the intellectual property rights of others
  • Attempt to gain unauthorized access to other users' accounts, data, or any systems or networks connected to the Service
  • Use automated tools to scrape, overload, or disrupt the Service or circumvent storage limits
  • Share API keys or account credentials with unauthorized parties
  • Upload malicious files or content designed to exploit vulnerabilities
  • Resell, sublicense, or otherwise commercialize access to the Service's API or MCP server without our prior written permission
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

8. AI Output Disclaimer

Symbol provides AI tools with access to your knowledge base to facilitate AI-assisted workflows. Symbol itself does not generate AI responses. We make no representations, warranties, or guarantees regarding the accuracy, completeness, reliability, or fitness for any particular purpose of content generated by AI tools using your Capsules. You are solely responsible for reviewing, validating, and determining the appropriateness of any AI-generated content before relying on or acting upon it.

9. Teams and Sharing

When you share Capsules with team members or via share links, you are responsible for ensuring the content is appropriate for the intended audience and that you have the right to share it. Team owners are responsible for managing membership and access levels within their teams. We are not liable for any unauthorized access resulting from share links or team permissions you configure.

10. Storage and Limits

The Service imposes storage limits on file attachments: 25MB per file, 50MB per Capsule, and 200MB total storage per user. File attachments expire after 30 days by default. We reserve the right to adjust these limits with reasonable notice to users.

11. API and MCP Access

API keys provide programmatic access to your account. You are responsible for keeping API keys secure. If you believe an API key has been compromised, revoke it immediately through your account settings. We may rate-limit API access to ensure fair use of shared resources.

12. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime. We shall not be liable for any loss or damage caused by unavailability of the Service.

13. Termination

You may delete your account at any time through your account settings. We may suspend or terminate your account, with or without notice, if you violate these Terms, engage in activity that harms the Service or other users, or for any other reason at our sole discretion. Upon termination, your content will be permanently deleted after a reasonable grace period. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Indemnification

You agree to indemnify, defend, and hold harmless Databoy Pro Sites Limited and its officers, directors, employees, agents, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the Service; (b) your content; (c) your violation of these Terms; or (d) your violation of any third-party rights, including intellectual property rights or privacy rights. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.

15. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by applicable law, we expressly disclaim all such warranties.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with these Terms or your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) USD $100 or (b) the total amounts you paid us in the twelve months preceding the claim. Some jurisdictions do not permit the exclusion or limitation of certain warranties or liabilities; to the extent such exclusions or limitations are not permitted under applicable law, our liability shall be limited to the maximum extent permitted.

16. Force Majeure

We shall not be liable for any failure or delay in performance of our obligations under these Terms caused by events beyond our reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, civil unrest, epidemics, pandemics, government actions, power or telecommunications failures, or internet disruptions.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Zambia, without regard to its conflict of law provisions. You agree to first attempt to resolve any dispute with us informally by contacting us. If a dispute is not resolved within 30 days of first contact, it shall be submitted to the exclusive jurisdiction of the courts of Zambia. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against us.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Databoy Pro Sites Limited regarding your use of the Service and supersede all prior and contemporaneous agreements, representations, and understandings between the parties relating to the subject matter hereof.

20. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
